SC rejects plea on 1956 pact on Telengana region

The Supreme Court on Monday dismissed a petition for enforcing the 1956 agreement signed by leaders of all political parties from Telangana and Andhra regions for creating United Andhra Pradesh in letter and spirit to help in subsiding the demand for separate state.
The petitioner accused the successive governments of discriminating the poor people of Telangana in terms of the government employment, education and allocation of funds and described it as the main reason for fuelling the demand of separate state. If the accord was implemented in letter and spirit the issue would have not surfaced, the petition said. “The violations of the agreement are cited as one of the reasons for demands for separate statehood,” the petition said.
The Supreme Court Monday dismissed a Hyderabad resident’s plea for implementing an agreement signed by regional leaders in 1956, pledging to protect rights and interests of the people of Telangana region in the new state of Andhra Pradesh then being formed.
A bench of Chief Justice K.G. Balakrishnan, Justice Aftab Alam and Justice Deepak Verma dismissed the plea saying that the court cannot entertain such petitions. The court cannot interfere with the policy decisions of the government, the bench said, dismissing the plea of Hyderabad resident M. Narsimha Swamy.
An advocate by profession, Swamy argued that the leaders representing the Andhra and Telangana regions, before the formation of the state in 1956, had entered into a Gentlemen’s Agreement to protect the rights and interests of the people of Telangana region. But the agreement remains a dead letter till date, said Swamy and sought directions to the central and state governments for implementing the accord.
Swamy said the accord provided for due and proper devolution of funds for development of Telengana region, which has been consistently ignored by leaders of Andhra region.
But the bench dismissed the plea, cutting short Swamy’s argument.
